The Russian Federation has received a loan from the International Bank for Reconstruction and Development towards the cost of the Judicial Reform Support Project and intends to apply part of the proceeds as illegible payments under the contract for consulting services for Analysis and Generalization of the Practices of the European Court of Human Rights in the Context of the Constitution of the Russian Federation and the Russian Legislation (Contract # JRSP/2/A.5.4).
The main objective of the consultancy is to develop, create and fill content into the electronic database Practices of the European Court of Human Rights in the Context of the Constitution of the Russian Federation and the Russian Legislation and deliver it to the final customers (the Constitutional Court of the Russian Federation and the Supreme Court of the Russian Federation), to be integrated into the ICT systems of the final customers and to be regularly updated.
To perform the assignment, the Consultant should implement the following:
- Develop a glossary of categories and notions reflecting the content of the Constitution of the Russian Federation to be compatible with those of the Convention for the Protection of Human Rights and Fundamental Freedoms and Protocols thereto;
- Analyze rulings and judgments of the European Court of Human Rights (European Court) on Russian cases from 1960 to 2010 and European Court rulings on complaints against other countries in cases where norms of foreign law were applied similar to those of the Russian law;
- Based on the analysis, form a selection of direct detailed quotations from rulings and judgments of the European Court reflecting a specific legal position or a principle formulated by the Court, to be presented in the Russian language for filling the electronic database;
- Develop the electronic database in a format agreed with the final customers, fill in its initial content, and integrate the created database into the ICT systems of the final customers.
Under the assignment, the following stages are planned:
Stage 1:
- Develop, prepare, document and agree a pilot model of the interface of the database, the analysis structure, the classifier, the glossary and a text fragment, and a list and parameters of annexes to the database, in accord with the Terms of Reference;
- Establish and register legal links of clauses of the Convention for the Protection of Human Rights and Fundamental Freedoms and Protocols thereto and clauses of the Constitution of the Russian Federation;
- Select an array of European Court decisions for further analysis.
The estimated work duration under Stage 1 should not exceed 3 months.
Stage 2:
- Organize works to form the final glossary and the classifier and to prepare texts of related section of the database on the basis of rulings and decisions of the European Court, ensuring collection and storage of the materials in an electronic form;
- Analyze the selected array of decisions of the European Court following the agreed scheme;
- Develop (if necessary) and agree proposals for correcting content-related and technical parameters of the developed version of the database;
- Develop a report about the essence and results of the works under the stage.
The estimated work duration under Stage 2 should not exceed 6 months.
Stage 3:
- Correct parameters of the electronic database;
- Integrate the developed database into the ICT systems of the Constitutional Court of the Russian Federation and the Supreme Court of the Russian Federation. If necessary, instruct employees of the mentioned courts in usage of the integrated product;
- Develop a report about the essence and results of the works under the stage and a final report on the project.
The estimated work duration under Stage 3 should not exceed 2 months.
Foundation Bureau of Economic Analysis (BEA) acting as the Project Implementation Unit of the Judicial Reform Support Project hereby invites eligible consultants with proper qualifications to express their interest. The expression of interest should include attached materials to confirm that the consultants are qualified to render the services (brochures; descriptions of similar consulting assignments implemented, including information about their duration, contract price and the role of the company; evidence of work experience in similar conditions and of availability of appropriate skills among staff). Consultants may associate to enhance their capabilities and submit joint expressions of interest.
A consultant will be selected in accordance with the QCBS (Quality- and Cost-Based Selection) procedures set out in the World Bank’s Guidelines: Selection and Employment of Consultants by World Bank Borrowers (May 2004).
